NuFit Program Terms and Conditions

1. Introduction Welcome to the NuFit Program by
Nutrascia. These Terms and Conditions govern your participation in the NuFit
fitness and nutrition program. By enrolling in the program, you agree to comply
with these Terms and Conditions, so please read them carefully.

2. Program Overview NuFit is a personalized fitness
and nutrition program designed to help you achieve your health and fitness
goals. The program is tailored to your individual needs based on the
information you provide through the application questionnaire.

3. Eligibility

Participants
must be at least 18 years old to enroll in the NuFit Program. Individuals
under 18 may participate with parental or guardian consent.

You must complete the NuFit Program Application Questionnaire to receive a
personalized plan.

4. Health Disclosure AgreemeInformation: By enrolling in the NuFit Program, you agree to provide
accurate and complete health information, including but not limited to
your medical history, current health conditions, medications, and any
dietary restrictions.

Assum of Risk: You acknowledge that participation in the NuFit Program
involves physical activity, which may include strength training,
cardiovascular exercise, and other fitness routines. You understand and
accept the risks associated with physical exercise, including the risk of
injury, and agree to assume full responsibility for your participation.

Consultation with Healthcare Provider: You acknowledge that Nutrascia strongly
recommends consulting with your healthcare provider before beginning any
fitness or nutrition program, particularly if you have a pre-existing
medical condition or are taking medication.

Medical Supervision: Nutrascia provides medical supervision through its team
of healthcare professionals, but this does not replace regular
consultation with your personal healthcare provider. The information and
guidance provided by the NuFit Program are not intended to diagnose,
treat, cure, or prevent any disease.

5. Program Fees and Payment

Fees:
The fees for the NuFit Program are outlined on the Nutrascia website. You
agree to pay all fees associated with your selected plan.

Payment:
Payment must be made in full at the time of enrollment unless otherwise
stated. Nutrascia accepts various forms of payment as listed on the
website.

Refunds:
Refunds are subject to the NuFit Program Cancellation Policy. Please refer
to the policy for details on eligibility and the process for requesting a
refund.

6. Program Delivery Access:
Upon successful enrollment and payment, you will receive access to your
personalized fitness and nutrition plan through the NuFit mobile app.

Updates:
Your plan may be updated periodically based on your progress, feedback,
and any changes in your health or fitness goals.

Support:
You will have access to customer support and coaching through the NuFit
mobile app, email, or phone as specified in your plan.

7. Data Privacy

Confidentiality:
Nutrascia is committed to protecting your personal information. All data
collected through the NuFit Program is stored securely and handled in
accordance with our Confidentiality Assurance statement.

Use of Data: Your data will be used solely for the purpose of creating and
managing your personalized plan. We will not share your information with
third parties without your consent, except as required by law.

8. User Responsibilities

Accuracy of Information: You agree to provide accurate and complete information
in your application questionnaire and any subsequent communications with
Nutrascia.

Compliance with Plan: You agree to follow the fitness and nutrition plan provided
to you. Any deviation from the plan is at your own risk, and Nutrascia is
not responsible for any consequences resulting from non-compliance.

Prohibited Conduct: You agree not to share, distribute, or reproduce any content
from the NuFit Program without prior written permission from Nutrascia.

9. Intellectual Property

Ownership:
All content provided through the NuFit Program, including but not limited
to text, graphics, logos, and software, is the property of Nutrascia and
is protected by intellectual property laws.

License:
You are granted a limited, non-exclusive, non-transferable license to
access and use the content provided through the NuFit Program for
personal, non-commercial purposes.

10. Termination

Termination by Nutrascia: Nutrascia reserves the right to terminate your
participation in the NuFit Program at any time if you violate these Terms
and Conditions or engage in conduct that Nutrascia deems harmful to its
interests or the interests of other participants.

Termination by Participant: You may terminate your participation in the NuFit
Program at any time by providing written notice to Nutrascia. Termination
will be effective at the end of the current billing cycle.

11. Changes to Terms and Conditions

Nutrascia
reserves the right to update or modify these Terms and Conditions at any
time. Any changes will be communicated to participants via email or
through the Nutrascia website. Continued participation in the NuFit
Program after such changes constitutes your acceptance of the new Terms
and Conditions.

12. Governing Law

These
Terms and Conditions shall be governed by and construed in accordance with
the laws of the jurisdiction in which Nutrascia operates. Any disputes
arising under or in connection with these Terms and Conditions shall be
subject to the exclusive jurisdiction of the courts in that jurisdiction.

By enrolling in the NuFit Program, you acknowledge that you
have read, understood, and agree to these Terms and Conditions, including the
Health Disclosure Agreement.

NuFit Program Cancellation Policy

1. Cancellation Requests

All
cancellation requests must be submitted in writing via email to our
customer support team at the announced contact forms.

Please
include your full name, account details, and reason for cancellation in
your request.

2. Cancellation Deadlines

Monthly
Subscriptions: You may cancel your subscription at any time. To avoid
being charged for the next billing cycle, cancellations must be made at
least 7 days before the renewal date.

Annual
Subscriptions: You may cancel your annual subscription within the first 30
days of the initial purchase for a full refund, minus any used portion of
the program. After the first 30 days, cancellations can be made at any
time but will only take effect at the end of the current annual cycle.

3. Refund Policy

Monthly
Subscriptions: No refunds are issued for cancellations of monthly
subscriptions after the consultation sessions. You will retain access to
the program until the end of your current billing period.

Annual
Subscriptions: If you cancel within the first 30 days of your
subscription, you will receive a prorated refund based on the time
remaining in your subscription, minus the value of any used services.
After 30 days, no refunds are issued for annual subscriptions.

4. Changes to Your Subscription

You
may upgrade or downgrade your NuFit subscription plan at any time. Any
changes will take effect at the start of the next billing cycle. Upgrades
will be charged at the new rate immediately upon the next billing cycle,
while downgrades will apply at the new rate at the start of the next
billing period.

5. Early Termination

NuFit
reserves the right to terminate your subscription early if you breach any
of the program’s terms and conditions. In such cases, you will not be
eligible for a refund.

6. Contact Information

If you
have any questions about our cancellation policy or need assistance with
your subscription, please contact our customer support team.

7. Program Access Post-Cancellation

Upon
cancellation, you will retain access to the NuFit program and its features
until the end of your current billing cycle. After this period, access to
the program will be terminated.

8. Changes to the Cancellation Policy

NuFit
reserves the right to update or modify this cancellation policy at any
time. Any changes will be communicated to current subscribers via email
and will be effective immediately upon posting.
